- It is clearly stated in the application filed by the defendants and the application filed by plaintiff for withdrawal of suit that he has compromised with the plaintiff-appellant — Thus, the principle of estoppel as well as waiver according to his conduct is fully attracted — under law respondent cannot now turn around and question the validity of the decree.
