- Section 3 — Amendment and its applicability — Before coming into force of amended section 3, the previous order of 26.06.1967 was only applicable to a development scheme and the development scheme visualized under the order was only that which was certified to be so by the development Secretary. In this view of the matter, in the judgment under review, defence purpose was not included in the development scheme whereas on account of the new amended section 3, the words, the execution of the any development scheme, are substituted by the words “any public purpose”. Held: thus, it is clear that the defence scheme is very much a scheme falling within the purview of public purpose under the existing law. Custodian Evacuee property v.
