Proforma-respondent not served — Effect of — Whether failure to serve the proforma-respondent would result in the dismissal of the revision petition in the High Court in toto, or only to the interest of the proforma-respondents. Held: — No hard and fast rule can be laid down that failure to deposit process fee in case of proforma-defendant or a proforma-respondent, would entail a partial dismissal of the cause or it would result in its total dismissal — It depends upon the circumstances for which the concerned party was impleaded as proforma-defendant or proforma-respondent — In this case the decree for adverse possession was prayed for by the appellant and respondents No .11 and 12 jointly — The claim of the appellant and proforma-respondent was joint and inseparable and as such they were the necessary party to the suit or for that matter to the appeal.
