- Students who could not appear in the examination for the financial year 2005-06 cannot be penalised for the act/wrong of the authorities — Held: All those students who had to appear in any examination in year 2005-06 can validly claim exemption of payment of fee if the examination is conducted after the close of financial year 2005-06. - No one can be penalized for the fault of the authority. The competent authority has been guilty of making irregular appointments — It cannot be allowed to turn round and terminate the service of a person after inducting him in service on peranent basis.
