- The Govt. wants to remove from their posts such teachers who have now obtained P.T.C. training at Govt. expenses — It is within the competence of the Govt. to decide whether a particular qualification would be considered sufficient for promotion from a particular grade to a higher grade — It is within the domain of the Govt. to change the policy from time to time — The Govt. is competent to change its policy and even to prescribe different qualification than that which was initially fixed for a particular post — If any right on the basis of the policy of the Govt. has vested in due course of time to any citizen he cannot be deprived of the same later on — Appellants were inducted in service in the light of policy adopted by the Govt. at the relevant time — Under that policy many untrained persons, including the appellants, were inducted — The judgment of the High Court whereby the protection has been given to those who have completed P.T.C. maintained — However, this benefit was extended even to the present appellants who were deputed for departmental training at late stage and could not acquire P.T.C. qualification before the order of the High Court or got compartments and cleared subsequently after passing of the order by the High Court — Held: Valuable right has vested in favour of the appellants from which they cannot be deprived of by the Govt. Imdad Ali Shah v. Azad Govt. and others 2003 SCR 95 (D)
