- S.s — 37, 39 — Before an employee of the Bank is punished under S. 37 with any of the penalties the competent authority shall cause a charge sheet to be issued to the employee and then appoint an Inquiry Officer or Inquiry Committee under rule 39 — The second stage is that the Inquiry Officer or Inquiry Committee shall require accused employee to put in a written defence — while inquiring into the charges against an employee oral or documentary evidence has to be examined in support of the charges and the accused shall be entitled to cross-examine the witness against him — The accused is also entitled to produce oral or documentary evidence.— Inquiry on the basis of which accused respondent was dismissed was not in accordance with law.
