- It is an accepted principle of law that any material which was not part of file of the Shariat Court or the lower Court cannot be taken into consideration at the stage of appeal by this Court — This Court is vested with the power to see only that record which was part of file in which judgment under challenge was recorded — Application for allowing to file affidavits on behalf of witnesses rejected, as the material which was not before the Shariat Court cannot be taken into consideration at the stage of appeal.
