1. Trial Court directed the plaintiff to furnish security on or before 10.11.1999 — On aforesaid date the appellant and pro forma respondents failed to furnish the security and remained absent — The Court dismissed the suit for non-prosecution — Held: The Court should have dismissed the suit for non-compliance of the orders of the Court which was the requirement of law as they could not defeat the law by absenting themselves from appearance in the Court — The trial Court committed a mistake by dismissing the suit for non-prosecution — Appellant and pro forma respondents  are not serious in prosecuting the cause — Failed to furnish the security in due course of time — There is no ground for further extension of time — Appeal dismissed.
