- The notifications cannot override the substantive laws howsoever worded it may be — Govt. resolutions circulars, other instructions and orders cannot override the statutory provisions, nor can they be issued in contravention of the statutory provisions — Held: As a constitutional functionary the Courts owes a duty to protect the law enacted by the Parliament and if it is not doing that it will be failing in its duty having taken oath under the constitution.
