- Rule 25(1), chapter 12 — re-employment of police officer — conditions — refund of gratuity — cease to draw pension–counting of former service — According to sub-rule 1 of Rule 25 of Chapter 12 of the Police Rules a police officer may be reemployed in the police service up to the age of 55 years subject to the given conditions. The statutory provision is unambiguous and clear that in case of refund, the re-employed person is vested with the right of counting his former service for future pension. Mst. Sahib Jan & others v. - Re-employment of service — two options available to police officers — According to the statutory provisions of reemployment, in such like circumstances there are two options; either a re-employed person should continue his pension and waive his right of counting re-employed service for future pension, or to refund the pensionary benefits and take benefit of counting the reemployed service for future pension.
