- When the review petition filed by the appellant was not decided within the statutory period of 90 days and he filed appeal to the Service Tribunal, his review petition would be deemed to have been rejected by fiction of law; once the appeal is preferred to the Service Tribunal by a civil servant, the departmental authority becomes ‘functus officio’ to deal with an appeal, representation or review petition.
