- Seniority list issued after the issuance of impugned notification regarding regularization of ad hoc appointment of the respondent with the approval of the Government retrospectively when the review of the appellant was already sub-judice before the Govt. The appellant was not obliged to challenge the seniority list specifically in the circumstances as the question of his seniority was directly related to the notification which was already subject of challenge.
