- Section 2 — Courts & Laws Code, 1949 — section 48 — inheritance — property left by a deceased muslim (enunch) — customs & usages — disciples of enunch claim the property on the basis of custom — under section 2, the rule of decision shall be the Muslim Personal Law, in case the parties are Muslims — same is the spirit of section 48 of the Courts and Laws Code — inheritance of the property of Muslim will devolve upon his legal heirs according to Shariah which has overriding effect upon all other laws including the customs or usages — no one can inherit the property on the basis of custom —. the property of deceased will devolve upon his legal heirs and not the disciples according to the custom.
