1. The word ‘wilful defaulter’ has not been defined in the AJK Legislative Assembly (Elections) Ordinance, 1970 — Naturally in absence of definition of words ‘wilful defaulter’ in the relevant statute, we have to revert to ordinary dictionary meaning of the words ‘defaulter’ and ‘wilful defaulter’ — Black’s Law Dictionary, the law terms and phrases judicially interpreted and legal maxims and foreign legal words and phrases in ordinary usage referred. The word ‘wilful’ when used in statutes, connotes different concepts — In certain cases “wilful” may mean “wantonly” — In certain cases it may mean “intentionally” or “deliberately” and in other cases it may merely mean “consciously” — Held: That the Chief Election Commissioner as well as the High Court failed to take into consideration the definition of word “wilful” — The definition of word “wilful” is “premeditated; malicious; done with evil intent, or with a bad motive or purpose, or with indifference to the natural consequences; unlawful; without legal justification”.
