- Section 44(2) clause (A) (I), AJ&K Interim Constitution Act, 1974 — first to determine — nature of locus stand of petitioner — writ of mandamus which is subject matter of clause (A) (I) of subsection 2 of Section 44 of Act, 1974. Constitutional provision speaks that for issuance of writ, precondition is that the concerned be directed to do that which is required by law to be done or to refrain from doing that which is not permitted by law to be done. The phraseology of this statutory provision clearly reveals that for exercise of extraordinary writ jurisdiction, the nature of locus standi of the petitioner has to be firstly determined whether the claim is legally enforceable.
