AJK Delimitation of Constituencies Ordinance, 1970

  1. —Sections 7 & 8—delimitation commission—functions & obligations of— it is job of the Commission to divide each district into as many territorial constituencies as the number of such seats set out in relevant schedule—the validity of the act of  Commission is not questionable—all actions taken, which are not contrary to any provision of Ordinance, shall be deemed to have been taken validly– while conducting the delimitation process it is duty of the Commission to look into the population, administrative convenience of the people and compactness of the area of a constituency— delimitation process is conducted to mark or lay out the limits or boundary lines of a territory—the process of delimitation is one of the important steps to organize and conduct election.   2. —Section 7—delimitation of constituencies—object of— process of delimitation has to ensure that the voting equality is not disturbed—delimitation is a judicious exercise of delineating electoral area, vigilantly guarding against any possible fear of vote dilution, disenfranchisement or corrupt practices—it is commonsensical that ‘Delimitation’ must be a neutral exercise, conducted by a neutral body— any partisan political intervention may lead to gerrymandering and unjust political windfall etc. Inhabitants of constituency No.LA-XXVIII Versus Waheed Mughal & 18 others 2021 SCR 144 (C) 2005 MLD 1724 & PLD 20111 Lah 221 ref.
  3. —Section 7—delimitation of constituencies—object & purpose of—delimitation cannot be made on the desire of political workers– the Commission has to keep in mind the large interest of all the people of the constituency—in the Govt. sector the number of posts is filled in constituency-wise—if the population of a constituency is much more than the other, then the eligible persons holding greater number of population, shall have less space for adjustment—the basic object of delimitation is to secure equal representation for equal segments of the population in the legislative bodies—purpose of delimitation is to equalize the electorate per seat in accordance with the principle of ‘one person, one vote, one value.
