- —contempt of Court—violation of judgment of the Supreme Court—Argument: land whereupon contemnor made encroachment does fall into Master Plan of Mirpur city, hence no violation of judgment of the Supreme Court committed—No contempt of Court committed. Held: Land adjacent to the Mangla lake and within the municipal limits—Directions given in Azeem Dutt’s case applicable on this case—Argument repelled. In Muhammad Azeem Dutt’s case (2017 SCR 577) the master plan of Mirpur city was under consideration, whereas, the land in question is not included in the master plan, therefore, it cannot be said that the respondent violated the directions of this Court issued in the referred judgment; as in the judgment (supra) the observations/directions have also been given regarding the land situate within the municipal limits as well as for protection of the land reserved for public place/public purpose. Held: As the land in question is a State land adjacent to the Mangla Lake which also falls within the definition of public place, moreover, the same is situate within the municipal limits; therefore, it cannot be said that the directions given in the judgment (supra) are not applicable in the instant case.
