1. —Section 19 (e)—Kashmir Institute of Management Rules, 2013—Civil Servants Act, 1976—persons serving in Kashmir Institute of Management are provided protection under the Act—under Rule, 2013 the persons, subject of rules, are serving against civil posts of permanent nature and their terms and conditions of service from recruitment to retirement are similar to those provided for civil servants under the provisions of Act, 1976 and the rules made thereunder.   2. — Kashmir Institute of Management Rules, 2013—Rule, 31— AJ&K Service Tribunal Act, 1975—Section 2(b) and 4—employees of  Kashmir Institute of Management —remedy of appeal before Service Tribunal—Neither the persons permanently appointed in the Institute have been specifically excluded from the definition of civil servants nor any special forum is provided for the remedy against imposition of punishment— the  policy and procedure applicable to the employees of the Government have been made applicable to the employees of the Institute—the respondent who was appointed by the competent authority on the recommendations of the Selection Committee against the civil post relating to the affairs of AJ&K is neither a temporary employee nor is on deputation, appointed on contract or work-charge basis, worker or workman—Held: he can be treated as civil servant for the purpose of filing of appeal under Service Tribunals (Procedure) Rules.
