- AJ&K Interim Constitution Act — Section 44 — Tribunals Jurisdiction & Powers — Argument that present Civil Servant have been discriminated as compared to Council’s Civil Servant with reference to the implementation of the extended benefit of leave encashment — Held: the point can be considered by the proper forum for the enforcement of constitutionally guaranteed fundamental rights to the state subjects. Such question does not fall within the domain of the Service Tribunal’s Jurisdiction. For the enforcement of the fundament rights which also include the question of discriminatory treatment extraordinary jurisdiction has been conferred upon the High Court. AJ&K Govt.&another v.
