- Sections 3 & 4 — constitution of tribunal & benches — Argument that a single member is not competent to finally adjudicate upon the matter — under section 3 (3) the Tribunal shall consist of two Judges nominated by the Chief Justice, the senior most of whom shall be Chairman — under section 4 the Chairman is empowered to constitute a bench consisting of one member with or without the Chairman and bench consisting of one member shall be deemed to be a Tribunal.
