- The material before the learned trial Judge with regard to the title of respondents and their possession over the suit property was insufficient for issuing the order of attachment of suit property and for appointment of receiver. The trial Court had also insufficient material with regard to the alleged defiance of the Stay Order issued by the trial Court. It was the duty of the trial Court to make some inquiry and to record some evidence showing the alleged violation of the Stay Order and then to proceed in accordance with law. M. Siddique v. M.
