- Appointment of Professors, B-20, Associate Professors, B-19 and Assistant Professors, B-18 through direct recruitment — AJ&K Education Service Class (1) Collegiate Branch Men’s Section Rules, 2001 — contention of the appellant that the 4-Tire formula does not visualize the appointment of Professors, B-20, Associate Professors, B-19 and Assistant Professors, B-8 through direct recruitment — Held: the notification which provides the appointment against the available posts on the basis of 4-Tier formula,1% quota for the posts of Professors, B-20, 15% quota for the posts of Professors/Associate Professors, B-19, 34% quota for the posts of Assistant Professors, B-18 and 50% quota for lecturer, B-17 against the available posts amongst the teaching staff having experience and qualification under rules is reserved. Several conditions have been imposed in the said notification. Condition No. (I) provides that the appointment against the available posts of Professors, Associate Professors and Assistant Professors on the basis of 4-tier formula shall be governed by such recruitment rules as framed or shall be framed from time to time for filling up the posts by promotion or recruitment as prescribed in the said rules. The Rules governing the appointment/promotions against the available vacancies of Professors, B-20 Associate Professors, B-19 and Assistant Professors, B-18 and Lecturer, B-17 are provided under schedule annexed to the AJ&K Education Service Class (I) Collegiate Branch Men’s Section Rules, 2001 issued on 18.01.2001 — an amendment in the said Rules was incorporated through notification dated 11th May, 2001, wherein, the word ‘Men’ or ‘Men’s’ were deleted, thus, these Rules are applicable to both the men and women civil servants, serving in the collegiate education services. Further held: under the Rules, 20% quota has been fixed for the post of Professors, B-20 by initial recruitment and 80% by promotion on the basis of seniority-cum-fitness from amongst the Associate Professors, B-19 having 17 years’ service in BPS-17 and above. Likewise, for recruitment against the posts of Associate Professors, B-19, 30% quota by initial recruitment and 70% by promotion has been fixed. For the posts of Assistant Professors, B-18, 25% quota by initial recruitment and 75% by promotion has been fixed, whereas, for the posts of Lecturer, B-17 only induction through initial recruitment has been provided. Further held: The juxtapose examination of notification visualizing the recruitment on the basis of 4-Tier formula and the Rules mentioned hereinabove, it is amply clear that the posts of Professors, B-20 Associate Professors, B-19 and Assistant Professors, B-18 can be filled through direct recruitment.
