- Interim Constitution Act — Supreme Court Rules — inherent powers — appeal — delay — condonation of — for doing complete justice, Supreme Court has got powers to condone the delay in filing of appeal for sufficient reasons — the death sentence was awarded in absence of the accused without hearing arguments on his behalf and the same affirmed by the Shariat Court in the same like manner — this being important proposition justifies exercise of inherent powers. - —Delay—condonation of—appeal against conviction—APC–Ss. 324 and 337 etc.— in the cases of conviction, the Courts liberally exercise the powers of condonation of delay— the wisdom behind is clear that at least the convicted person should have no doubt in his mind that his right of hearing has been denied— it is divine right, even the Allah Almighty who is omni potent, is so kind that he has also provided this right to His creatures—no doubt, the delay occurred in filing the appeal before High Court is unduly belated, but according to facts the appellant committed the alleged offence with the abetment of his brother who has been acquitted of the charge on the ground that no one has seen the occurrence and the prosecution story is full of doubts—delay condoned.
