1. Rule.13 — AJ&K Public Service  Commission (Procedure) Rules, 1994 — candidate from waiting list — appointment of — a candidate next in merit from the waiting list can only be appointed against the post if the selected candidate recommended by the Public Service Commission on the basis of merit fails to join the service or is declared medically unfit. There are two eventualities justifying the appointment from the candidate falling in the waiting list. (1) Validity of waiting list only for 180 days. (2) Waiting list not valid for fresh vacancy.   2. —writ—four candidates appointed against four advertised posts—None of them failed to join and no vacancy became available out of these four posts within 180 days—Held: no direction can be issued for appointment against the post which has neither been advertised nor became available within 180 days of the selection.   3. — induction in Local Gov. and Rural Development Dept. — the concept of appointment from waiting list exists only for the appointment made under Public Service (Procedure) Rules, 1994 and the Teachers Recruitment Policy, 2017 — in the rules of LG&RDD, there is no concept of appointment from the waiting list.  Secretary Local Government & others versus Majid Shahbaz & others 2023 SCR 882  (A) Home Dept.
