1. Suspension means “action of debarring or state of being debarred specially for one time, from a function or privilege, temporary deprivation of one’s office or position or state of being temporarily kept from doing or deprive of something” — It is also an axiom of law approved from time to time by the Courts of the subcontinent that the power to suspend a holder of a post is to keep him away from the office temporarily to avoid influence on the inquiry which has to be followed after suspension. Suspension is not a punishment and does not incur any disqualification or bar to rejoin the service if discharged by Inquiry Committee or Tribunal — Held: That after the finding recorded by the Service Tribunal the appellant is as good a grade 20 officer of the Forests Department as he was before issuance of the suspension order by the Government and he has a valid right to hold the post of BPS-20.
