- Held: It cannot be laid down as a rule that if a judicial Officer decides the bail application and the matter is remanded to the same judicial officer after setting aside the previous order he becomes disqualified from hearing the case. This necessarily may not be a ground for transfer, however, an apprehension may be created in the mind of the complainant party warranting transfer of the case. Muhammad Yaqoot v.
