- It is indeed correct that it is the prerogative of the Govt. to transfer any civil servant from one place to another but at the same time it is desirable that the Govt. and the concerned department should also take into consideration a uniform policy for all the Govt. employees irrespective of their political background. - The Government or the competent authority has a legal competence to transfer any civil servant to any post provided that a civil servant when asked to serve against a post outside his service or cadre, his terms and conditions of service as to pay cannot be less favourable than those to which he is entitled to in the parent department. Azad Govt. v. Dr. Shehla Waqar 2008 SCR 195 (B)
