1. —section officers—promotional quota of Superintendent, Assistant, Stenographer and Steno-typist—having eight years service—eligibility for promotion—Argument: the job of the Deputy Superintendent is at par with the job of Superintendent, moreover the word “etc”, has been used in the public notice, so case of appellants fully covered under the said word. Held: deputy Superintendents not included in the quota–After going through the rules, it appears that only the Superintendent(B-16), Assistant (B-14), Stenographer (B-15) and Stenographer (B15) and Stenotypist (B-12), having eight years’ service are eligible to be appointed as Section Officers (B-17), against the promotional quota. Admittedly, the appellants are holding the posts of Deputy Superintendent which is not included in the quota fixed for promotion against the post of Section Officer. This position was also confronted to the learned counsel for the appellants during the course of arguments, whereupon, he stated that although the post of Deputy Superintendent has not been mentioned specifically in the rules but the job of Deputy Superintendent is at par with the job of Superintendent, moreover, the word “etc” has been used in the public notice and the case of the appellants is fully covered under the said word. We do not agree with the learned counsel for the appellants as: when the post of Deputy Superintendent is not mentioned in the public notice is not helpful to the appellants as the public notice cannot be given the preference over the rules.     Shakil Ahamd & others v.
