1. Fundamental Right No. 8 and section 50 of Motor Vehicles Ordinance — Fundamental Right No. 8 confers a right on a citizen to enter into lawful profession or occupation and to conduct any lawful trade or business — It is also laid down in the provisio that apart from other things, a trade or profession may be regulated by a licensing system — The route permits which are issued under the Motor Vehicles Ordinance fall under the licensing system — The provisions of the Ordinance apply to all persons equally so for as they give opportunity to all persons to apply for obtaining route permits — There is a proper method of hearing and adjudication of rights — Appeals are also provided to higher forum so that rights of interested persons may be re-examined at a higher level — The only departure from these provisions is the provision contained in S.50 which vests overriding and uncontrolled powers in the Government.
