- Section 497 — Question as whether the offence falls within the ambit of ‘qatl-i-amd’ as defined under section 300, A.P.C., or it would be covered by section 315, A.P.C., is to be resolved by the trial Court after the completion of the trial — However, even if it is assumed for the sake of arguments that the prosecution story is correct, the question as whether the kick blow was sufficient to cause death of the victim of offence in the ordinary course of nature, can be resolved only after the statement of the Medical Officer who performed the post-mortem of the deceased is recorded by the trial Court — Thus, the matter is one of further inquiry.
