1. If a defence plea is palpable from the prosecution story itself the accused cannot be deprived of taking the benefit of the said version — Similarly if a defence version is taken and the same is not proved, the prosecution is not absolved of its responsibility to prove the case against the accused persons beyond any reasonable shadow of doubt — It is a cordinal principle of criminal jurisprudence that the prosecution in order to prove its case has to stand on its own legs and is burdened with the responsibility to prove the case against the accused persons.
