- To prove its case — for conviction — According to the celebrated principle of administration of criminal justice, it is almost settled that for conviction of an accused, the basic duty is upon the prosecution to prove its case through legal evidence by exclusion of all doubts. Falak Sher & another v. The State & another 2016 SCR 1467 (A)
- —to prove its case on its own evidence—mere suggestion pointed out by complaint do not constitute the case as proved without reasonable doubt— the prosecution has to stand on its own evidence and mere on the strength of some suggestions pointed out by the complainant, it cannot be said that the case against convict has fully been proved without reasonable doubt. Muhammad Younas v. The State & others 2019 SCR 149 (E)
