1. Services department moved the Law Deptt. to file appeal on 24.7.2000 — There is a note of Deputy Secretary Law that Law Minister being not available at headquarters the appeal may be filed subject to approval of Govt. — Additional Secretary Law, also opined that a very short period is left for filing the appeal, the same may be filed subject to approval by the Govt. — Approval of Law Minister was obtained on 23.8.2000 when the period of limitation for filing the appeal has already expired — The appeal was filed without the approval of Govt. and the Govt. did not give any ex-post facto sanction to validate the Govt. order dated 29.7.2000 —  Services Deptt. had been negligent enough to move the law Deptt. at a very late stage — The Govt. did not authorise the filing of present appeal in this Court — The appeal was not maintainable. Petition was filed before this Court without the prior sanction of the Govt. — Petition is not properly constituted, same is liable to be dismissed on this ground. — If any party has not raised any question of law which goes to the root of the case — Court may allow such point to be raised. The special institutions have the exclusive jurisdiction in the sphere of their functions assigned to them under law but they cannot indulge in the matters outside the sphere of the relevant law without the sanction of the Government — Litigation in any matter in any Court is an extraneous matter — The Ehtesab Bureau cannot indulge in litigation before the superior forums, like the High Court and the Supreme Court in any matter having penal consequences without sanction of Government.   4. Appeal before the Supreme Court without prior permission of the Government — Its maintainability. Held: Appeal in the Supreme Court can only be filed with prior sanction of the Government as postulated by the provisions of Ehtesab Bureau Act, Rules of Business, 1985 and Law Department Manual 1984.  Appeals dismissed having been filed incompetently.
