Posting and transfer of civil servants in absence of prescribed policy — Exercise of powers — Section 3(5) of AJK Interim Constitution Act provides — Islam, the State religion — No law repugnant to teachings of Islam. Further held: Every authority is under the constitutional obligation while exercising powers to be mindful of the fact that the authority and powers vested in him, is a trust bestowed upon him by Almighty Allah and he has to discharge his duties strictly in compliance of the command of Almighty Allah by rendering back the trust to whom they are due, which means that there is no room of any arbitrariness, discrimination, favoritism, nepotism or acceptance of any type of influence or pressure.   5. Bequest of the deceased — interpretation of — inheritance — Benami transactions — Al- Qur’an —Surah Al. Nisa — verses No. 29-33 — the bequest of the deceased will be treated as property which was in his ownership and not the property of the others whether it is under his control or possession as Manager, Trustee, Benami, ostensible or under some partnership or contract — Allah almighty has warned that no one should usurp the property of others. Held: in the light of the verses of Holy Qur’an, it will be disobedience and violation of the Allah Almighty’s command to claim inheritance of property which was not owned by the deceased or it was in the joint ownership with others and he was holding it as benami transaction or being a manager of the community.
