- Article 109 — It is a stringent provision — Whereas the provisions of Efficiency and Discipline Rules and AJ&K Civil Servants (Appointment and Conditions of Service) Rules, 1977, are less “stringent” and in view of written Constitution and on the basis of judge made law it is by now a settled principle of law that less stringent provision shall apply.
