Article 109 — In presence of specific provisions — Is not applicable and does not hold field — Held: Article 109 K.S.R. or for that matter any provision in respect of which AJ&K Legislative Assembly or AJ&K Council has enacted any law that only shall hold field and resort to any provision of K.S.R. is not permitted. Article 109 — It is a stringent provision — Whereas the provisions of Efficiency and Discipline Rules and AJ&K Civil Servants (Appointment and Conditions of Service) Rules, 1977, are less “stringent” and in view of written Constitution and on the basis of judge made law it is by now a settled principle of law that less stringent provision shall apply.   3. —Chapter XXI—Regulation Nos. 264 to 268—record of service— in case of a non-gazetted officer, a “service book”, in the prescribed form, is maintained by the Head of the office— Service book keeps moving with that officer whenever he is transferred–on promotion to the gazetted post, service book is transferred to the Accountant-General—the record of service of a Gazetted Officer is maintained by the Accountant-General who audits the salaries.
