1. Section 57, APC — Maximum punishment of imprisonment is the life imprisonment — under the provision of section 57 of the APC is to be reckoned as equivalent to the imprisonment for 25 years. Held: according to the enforced law, maximum period of punishment of imprisonment cannot be more than 25 years — Further held: if a person who remained under custody for the alleged offence, not given benefit of deduction of such period, practically it will amount to cross the maximum limit of 25 years of imprisonment — Whereas according to the enforced law, no one should be awarded punishment of imprisonment more than that of life imprisonment i.e 25 years.
