- There is no express provision in Limitation Act or C.P.C. like O.IX C.P.C. and Article 163 of Limitation Act providing procedure and limitation for such application — Limitation of 60 days provided by Article 163 does not apply to such applications as it refers to the “suit” not to the application — Article 181 of Limitation Act refers to an application for which no period of limitation is provided — Limitation in such cases is three years — Hence such cases appear to be regulated under the inherent powers of Court under sections 141 and 151 C.P.C. — Limitation for which is regulated by Article 181 of Limitation Act.
