1. Muhammad  Mushtaq Advocate was prosecuting the writ petition on behalf of the appellants and proforma respondents — He made an offer before the Court that litigation be resolved on oath — His statement to that offer was recorded by the Court — As he had no power of attorney on behalf of rest of the appellants and proforma respondent the statement of Malik Muhammad Yousaf, Advocate was recorded — It is not disputed that oath was not administered in the terms of offer — It is also not disputed that answering respondents had not accepted the offer — However, the objection is that the statement of respondent was not recorded by the Court — This Court in case Abdul Hameed V. Muhammad Najeeb has held that statement given on oath must be recorded. Mushtaq Ahmed v. Custodian Evacuee Property AJK & 11 others 2003 SCR 431 (A)
