- A specific order against any person whose appointment order has not been challenged specifically, cannot be passed without providing him an opportunity of hearing — regarding the appointment of any specific person when it will be challenged, the Court will be in a position to record any specific findings in this regard. - Section 5 — AJ&K Service Tribunal Act, 1975 — according to the statutory provision the tribunal may, on appeal, affirm, set-aside, vary or modify the order appealed against.
