1. Inheritance of — The moot point is as to whether any specific plea was taken in the written statement that there existed a partnership between Badi-uz-Zaman, Syed Ghulam Abbas and Major Shujat and they shared profit, except that the plot was allotted to Badi-uz-Zaman as Managing Director of Badi-uz-Zamanand sons, CALTEX Petrol Dealers — There is no evidence either that the aforesaid three persons acted for one another and shared the profit of the business in pursuance of any agreement — Thus, the mere vague averment made in the written statement that the plot in question would be inherited according to the principle of survivorship, is no proof that the aforesaid three persons consituted a firm within the meaning of Partnership Act — The plot in question would be governed by ‘Fiqa Jafria’ and not by any agreement.
