S. 9 of AJ&K Civil Servants Act, 1976 transfer of civil servants — The Government under section 9 of AJ&K Civil Servants Act has jurisdiction to transfer a civil servant anywhere against any post subject to conditions specifically mentioned therein — This authority of the Government even if considered to be absolute, the principle of administration of justice holds field that colourful exercise of jurisdiction vitiates most sacred powers under a codal provision — Held: It is well established that where an authority is vested in a functionary that power has to be exercised strictly according to rules, the violation of which vitiates the order so issued.
