Difference of Qisas and Tazir — Held: that difference between Qisas and Tazir is that in case of Qisas the Court has no discretion in the matter of sentence, whereas, in case of Tazir the discretion lies with the Court to award sentence of death or life imprisonment — Further held: For awarding the sentence of Qisas the requirements of section 304, APC are required to be fulfilled. Difference between Qisas and Tazir — The only difference between Qisas and Tazir is that, in case of Qisas no discretion is left with the Court except to award the sentence of death, whereas, in case of Tazir, the discretion lies with the Court to award the sentence of death or life imprisonment, according to the circumstances of the case.
