- The point raised was that it is clearly stated in the Family Courts Act that Civil Procedure Code will not be applicable to proceedings under this Act — Therefore res judicata and estoppel are not applicable — Another question which arises is whether a fresh suit on behalf of a wife who has withdrawn an earlier suit for dower after a compromise in which dower has not been given up is maintainable or not — These are points of law of public importance — Leave to appeal granted.
