Standard of proof

The principle of standard of proof in civil cases has now been almost settled that when both the parties adduce their evidence in support of their respective claims, the Court will assess and make opinion on the basis of cumulative effect of the evidence in whose favour there is probability of preponderance.  Muzaffar Hussain Shah & 8 others v.
