1. Contention  that after recording the statement of the attorney of the plaintiff, the statement of the plaintiff cannot be recorded — Held: to reach the right conclusion, if need arises, the trial Court can summon the plaintiff for recording the statement even if her/his statement has been recorded through attorney — Further held:  the trial Court while recording the evidence has to apply its judicial mind carefully and also take all the steps for clearing any doubt/ambiguity created by different pieces of evidence.
