1۔ Para 2, clause (iii) — transfer in exceptional cases — considerations — grounds assigned for transfer as given in transfer policy — cannot termed as unwarranted stigma — rather statutory requirement — According to the principle of law enunciated by this Court, if the transfer order has to be made in exceptional cases , the departmental authorities are bound to assign the reasons especially in the matters falling under clause (iii) para 2 of the transfer policy which speaks that: “ for the transfer, along with the period of posting, performance, suitability, experience, honesty, public acceptance, satisfactory performance of duties have also to be considered whereas on the grounds of dissatisfactory performance, absence from duty , misconduct, dishonesty, immoral behaviour , illegal activities, a civil servant can be transferred anywhere at any time. Thus , in view of this clear provision of the transfer policy, the reasons advanced in the transfer order cannot be termed as unwarranted stigma rather the same have been mentioned keeping in view the requirement of the provisions of the enforced policy.
